Understanding U.S. EB-5 Investment Immigration in Plain Terms: A Stable Immigration Strategy for Families Planning to Live in the United States

The EB-5 Immigrant Investor Program allows families to obtain U.S. green cards through qualified investments and job creation. With the 2022 reform introducing concurrent filing and visa set-asides, the program has become more efficient and flexible, making it a practical option for many families seeking U.S. residency.

When planning for a U.S. green card, long-term residence in the United States, employment, or accompanying children for education, most families often face confusion when selecting among various immigration programs.

Among the many U.S. immigration pathways, the EB-5 Immigrant Investor Program stands out due to its low entry threshold, high flexibility, and broad eligibility, making it a preferred option for ordinary families seeking U.S. residency.

Especially after the implementation of the U.S. EB-5 Reform and Integrity Act of 2022, the program has been extended through September 30, 2027. With new benefits such as visa set-asides (no backlog) and concurrent filing, the traditional shortcomings of EB-5 have been significantly improved, making it one of the most stable immigration planning options for families today.

01 Core Logic of EB-5

EB-5 is an official U.S. government investment immigration program with a straightforward rule:

Foreign investors invest a specified amount into a qualified U.S. commercial project, contribute to local economic development, and create at least 10 full-time jobs for U.S. workers. In return, the investor, spouse, and unmarried children under 21 may apply for U.S. permanent residency, achieving family immigration through a single investment.

EB-5 currently has two investment tiers suitable for different applicants:

$800,000 for Targeted Employment Area (TEA) projects

$1,050,000 for non-TEA projects

TEA projects are the most cost-effective and the preferred choice for most investors. These areas include rural regions, high-unemployment urban areas, and infrastructure projects. Due to weaker economic conditions, the U.S. government reserves dedicated visa allocations for these projects to attract foreign investment.

02 Four-Step Application Process

The EB-5 process is standardized, mature, and stable, with clear steps:

Select a qualified and compliant EB-5 project with stable operations;

Prepare documents such as salary income, real estate transactions, and investment income to prove lawful source of funds;

File Form I-526E immigrant petition;

Upon approval, receive a two-year conditional green card.

Within 21 months before the conditional green card expires, investors may file Form I-829 to remove conditions. Upon approval, they will receive a permanent green card valid for life, renewed every 10 years.

For applicants already holding valid visas and physically present in the United States, the new policy allows concurrent filing:

At the time of filing I-526E, applicants may also submit Form I-485 adjustment of status, work authorization, and advance parole. This allows them to obtain a Combo Card quickly, enabling legal residence, employment, and international travel without waiting for immigration approval, effectively solving the status gap issue for families in the U.S.

03 Key Investor Questions

01 Can the investment be fully returned?

EB-5 is a policy-based at-risk investment. Funds must remain at risk during the conditional residency period in compliance with U.S. immigration regulations.

If the project operates normally, meets job creation requirements, and has no compliance issues, the principal investment of $800,000 may be returned upon completion of the immigration cycle. Only administrative and legal fees are non-refundable. The new policy also reduces the minimum investment period to two years, significantly shortening capital lock-up time.

02 How is source of funds verified?

The U.S. immigration authority only requires that funds are lawfully obtained. Common sources include real estate sales or mortgages, corporate dividends, personal salary income, investment returns, and inheritance or gifts. As long as complete bank statements, tax records, and transaction documents are provided, approval is generally achievable. There is no need to explain all personal assets.

03 Do past visa refusals affect eligibility?

If previous refusals are not related to fraud, false documentation, or criminal violations, they generally do not affect EB-5 eligibility. The overall review process is highly flexible.

04 Can purchasing real estate qualify as EB-5 investment?

No. Purchasing private real estate does not qualify as a policy-based at-risk investment and does not create eligible employment, therefore it does not meet EB-5 requirements.

04 Key Criteria for Project Selection

The main EB-5 risks include immigration approval risk and capital loss risk. Selecting the right project is critical.

Investors should focus on:

Developer qualifications and past approval/repayment track record

Industry stability and future outlook

Job creation methodology compliance

Capital protection and repayment structure

Rural TEA projects enjoy priority processing and significantly higher approval rates compared to urban projects, making them the optimal choice under current policy.

05 Main U.S. Immigration Categories

U.S. employment-based immigration includes multiple categories for different applicants.

For highly educated or exceptionally talented individuals, options include EB-1A Extraordinary Ability and EB-2 NIW National Interest Waiver. These do not require investment or employer sponsorship and are suitable for individuals in science, technology, academia, or business.

For families without advanced professional qualifications, EB-5 remains the optimal solution.

EB-5 has almost no entry barriers, with no requirements for education, language, work experience, or business background. Even minors can apply independently.

There is also no strict residency requirement, allowing applicants to maintain their home-country lifestyle and career while obtaining U.S. permanent residency. With an investment of $800,000, families can achieve immigration, and the principal may be returned upon completion, making it highly cost-effective.

Leveraging benefits such as concurrent filing, visa set-asides, and faster processing, EB-5 effectively addresses long-standing issues such as visa backlogs, status gaps, and inability to work legally. It remains one of the most stable and cost-effective immigration options for students, families planning overseas residency, and those pursuing U.S. education pathways for their children.
